HOLIDAY FOR THE BRR...AVE CONTEST

Organiser & Eligibility
  1. This NESTLÉ DRUMSTICK® Holiday for the BRR…AVE™ Contest [“the Contest”] is organised by Nestlé Products Sdn. Bhd. [45229-H] [“the Organiser”] and is open to all Malaysian residents of 14 years of age as of 31/10/2009.
  2. The following group of persons shall not be eligible to participate in this Contest:
    1. Employees of the Organiser [including its affiliated and related companies] and their immediate family members [children, parents, brothers and sisters, including spouses]; and/or
    2. Representatives, employees, servants and/or agents of advertising and/or promotion service providers of the Organiser [including its affiliated and related companies], and their immediate family members [children, parents, brothers and sisters, including spouses].
Duration
  1. The Contest will run from 01/11/2009 at “00:00:01” to 10/01/2010 at “00:00:00” [“the Contest Period”]. The Organiser reserves the right to revise the Contest Period at any time. All entries received outside the Contest Period will be disqualified.
Submission of Entries & Qualifying Criteria
  1. To participate in this Contest, you will need to purchase any of the four [4] participating NESTLÉ DRUMSTICK® ice creams [Strawberry Classic, Vanilla Classic, Chocolate Classic or KIT KAT®] [“Participating Ice-Creams”].
  2. Only selected Participating Ice-Creams will have the Contest mini-sleeve, which is either printed with an eight [8] alpha numeric Proof of Purchase code [“POP”] or a free NESTLÉ TROPHY® Instant Prize [“Instant Prize”].
  3. Participants with the valid POP codes are entitled to stand a chance to win the Holiday for the BRR…AVE™ Contest Grand Prizes or Consolation Prizes by sending a short messaging service [“SMS”] from any locally registered mobile number. Each entry sent via SMS to 36006 must be completed with the keyword, new IC number, and the eight [8] digit code number from the Proof of Purchase, in the following manner:

  5. Each unique eight [8] digit code from the POP is valid for only one [1] Contest entry.
  6. Each qualified SMS received during the Contest Period will be serialized according to the time of receipt.
  7. Each SMS costs RM 0.30 and the standard telecommunications charges apply.
  8. Each participant may submit more than one [1] entry which must include the required POP code and fulfill the entry requirements as stated.
  9. Each participant is identified by their IC number submitted in the SMS.
  10. Participants MUST keep the POP code with the eight [8] digit unique code number used for the verification of the winners’ and to redeem the prize. Failure to do so will result in disqualification.
  11. If the participant finds a printed redemption for one [1] free NESTLÉ TROPHY® ice cream [“Instant Prize”], the participant is not entitled to a POP code.
Prizes
  1. The Prizes for this Contest consists of three [3] categories.
  2. Category 1: Instant Prize
    • There will be one hundred thousand [100, 000] prizes to be won for this category. Each winner will receive one [1] free NESTLÉ TROPHY® ice cream.

  3. Category 2: Grand Prize
    • There will be a total of ten [10] Grand Prizes to be won for this Contest. Each week, there will only be one [1] selected winner.

      The weekly Contest Period is as below:
      • Week 1 : 01/11/2009-07/11/2009
      • Week 2 : 08/11/2009-14/11/2009
      • Week 3 : 15/11/2009-21/11/2009
      • Week 4 : 22/11/2009-29/11/2009
      • Week 5 : 30/11/2009-06/12/2009
      • Week 6 : 07/12/2009-13/12/2009
      • Week 7 : 14/12/2009-20/12/2009
      • Week 8 : 21/12/2009-27/12/2009
      • Week 9 : 28/12/2009-03/01/2010
      • Week 10 : 04/01/2010-10/01/2010

      1. The total POP codes received each week will be serialized and will be divided by two [2] to derive the winning serial number for the weekly Grand Prize.

        For example:

        If the total qualified serial numbers is 4000 entries for that given week, then the total will be divided by
        two [2] to derive the winning serial numbers for the weekly Grand Prize. The winner will be entry with serial number 2000th.

        If the total serial number is an odd number, the weekly Grand Prize Winner will be the closest, lower whole serial number that results after the stated division.
      2. The weekly Grand Prize Winners will be able to invite one [1] guest each only.
        There will be a total of ten [10] Grand Prize Winners and will each receive:
        • The 9 days 6 nights African Safari holiday package for two [2] persons worth Ringgit Malaysia nine thousand [RM 9,000] only.
        • Airport and ground transportation in Cape Town, South Africa only. Transportation in Malaysia is the responsibility and expense of the winner and the invited guests.
        • Six [6] nights accommodation
        • Three [3] meals a day. The Organiser shall use its best endeavours to provide Halal meals, if required.
        • Assistance in obtaining the travel visa and custom clearance.

      3. The Grand Prize Winner and the accompanying one [1] invited guest shall leave and travel together to South Africa on 20/03/2010 [“Scheduled date”], to accommodate the necessary arrangements for travel.
      4. The Grand Prize Winner and the accompanying one [1] invited guest must obtain valid Malaysian passports, at their own expenses, must qualify for the visas issued by the South African authorities and obtain the South African security clearance check.
      5. In the event that the Grand Prize Winner is not able to travel on the Scheduled Date for any reasons whatsoever including and not limited to ineligibility for a passport and/or visa and/or fails to qualify the South African security clearance check, the whole Grand Prize package, including for the invited guest, shall be forfeited. The Organiser shall not reimburse or compensate the winner for failure of the winner to travel on the Scheduled Date.
      6. All prize packages, details and specification are subject to change at the sole and absolute discretion of the Organiser.

  4. Category 3: Consolation Prize
    • There will be a total of thirty [30] Consolation Prizes to be won for this Contest. Each week, there will be only
      three [3] selected weekly Consolation Prize winners.

      1. The total POP codes received each week will be serialized and will be divided by three [3] to derive the winning serial numbers for the weekly Consolation Prize.

        For example:

        If the total qualified serial numbers is 4000 entries for that given week, then the total will be divided by
        three [3] to derive the winning serial numbers for the Consolation Prize of the given week. The winners will be entries with serial number 1333rd, 2666th and 3999th.

        If the total serial number is an odd number, the weekly Consolation Prize Winner will be the closest, lower whole serial number that results after the stated division.
      2. In total, there will be thirty [30] Consolation Prize Winners who will each receive:
        • One [1] Panasonic (LUMIX) digital camera worth RM500

      3. The weekly Contest Period is as stated above.
Prize Redemption
  1. The Instant Prize winners can redeem one [1] NESTLÉ TROPHY® ice cream. Redemption can be done at the participating NESTLÉ DRUMSTICK® Holiday for the BRR…AVE™ outlets. Redemption of the Instant Prize must be made by 31/01/2010. No redemption will be entertained after 31/01/2010.
  2. For the purposes of verification, the winners of the weekly Grand Prize and the Consolation Prize MUST send the winning POP code with the eight [8] digit code number used and a photocopy of the winner’s IC within five [5] working days of receipt of the notification, via registered mail or courier to the address provided in the said notification, in order to redeem their Prize. Defective POP(s) and/or failure to furnish any of the POP and/or IC photocopies will result in disqualification/forfeiture of the Prize. Proof of postage shall not constitute proof of receipt by the Organiser.
  3. Upon verification and confirmation of the valid POP codes from the winners, prizes will be sent to the winner via registered mail to the residential address provided by the winner within 4-6 weeks.
  4. Each participant can win only one [1] Grand Prize or one [1] Consolation Prize throughout the Contest. In the event a winner wins two [2] or more prizes with different values, the winner will automatically win the prize of the higher value. The lower valued prize will be won by the participant with the following lower serial number. By the end of the Contest Period, there will be ten [10] Grand Prize Winners and thirty [30] Consolation Prize Winners.
  5. All prizes are not exchangeable for cash, goods or credit, in part or in full.
  6. The Organiser shall reserve the right at its absolute discretion to substitute any of the prizes with that of similar value at any time without prior notice.
  7. Winners will be notified via SMS or called on their contact number used to send the SMS. The Organiser will not be held liable in the event the winner(s) cannot be contacted for whatever reasons after at least three [3] attempts by the Organiser or its agents to contact the winners.

Liability & Responsibility
  1. The Organiser shall not be held liable or responsible for any delay and/or failure in the receipt of SMS entry due to the respective telephone company network or ISP failure and/or inability to provide timely and/or efficient SMS services. No proof of SMS sent made will be entertained.
  2. Winners shall assume full liability and responsibility in case of any liability, mishap, injury, loss, damage, claim or accident (including death) resulting from their participation in this Contest, redemption and/or usage of the prizes. The Organiser shall not be responsible for any liability, mishap, loss, damage, claim or accident (including death) in any manner whatsoever.
  3. All transportation, SMS, postage/courier, personal costs and/or any other costs, fees and/or related expenses that are incurred to participate in this Contest and to redeem the prizes are the sole responsibility of the winner, and the winner must abide by the terms and conditions of the party(ies) arranging and/or for the prizes and the terms and conditions attached to the prizes, if any.

Rights of the Organiser
  1. The Organiser shall reserve the right to publish, use the names and/or photographs of the winners as materials for the purposes of advertising and/or trade publicity, without any prior notice to the winners and the winners shall not be entitled to claim ownership or other forms of compensation on the materials.
  2. The Judges’ decisions are final and no correspondence thereon will be entertained
  3. By participating in this Contest, participants agree to be bound by this Contest Rules and Regulations, and the decisions of the Organiser.
