Organiser & Eligibility

1. This Nestlé 100 Years Incredible Story Contest ["Contest"] is organised by Nestlé Products Sdn. Bhd. [45229-H] ["the Organiser"] and is open to all Malaysian residents with a valid MyKad aged 18 years and above as of 1 February 2012.
2. The following group of persons shall not be eligible to participate in this Contest:
   • Employees of the Organiser [including its affiliated and related companies] and their immediate family members [children, parents, brothers and sisters, including spouses]; and/or
   • Representatives, employees, servants and/or agents of advertising and/or promotion service providers of the Organiser [including its affiliated and related companies], and their immediate family members [children, parents, brothers and sisters, including spouses].

Duration

1. To participate in this Contest, participants are required to submit an incredible story relating to any one of the Nestlé brands of their choice.
2. Participants may participate in this Contest either via the Microsite, Facebook, Twitter or Entry Forms via Roadshow, as described below:-
   • Category 1 – Microsite
     
     To participate, participants are first required to register at www.nestle.com.my/Nestle100Years ["Microsite"] by providing their names and date of birth.
     
     Participants may then choose to submit entries either in the form of text, photo, video or Twitter.
   • Category 2 – Facebook Application
     
     To participate via Facebook, participants must be registered as a member of the www.facebook.com website ["Facebook"]. Please refer to the Facebook's privacy policy and the terms and conditions on the Facebook, which will bind the members and users of the Facebook.
     
     To participate, members of the Facebook must first click the 'Like' icon on the Nestlé Fanpage at www.facebook.com/NestleMalaysia and register as members. Participants must then add the Nestlé 100 Years Incredible Story Contest Facebook application at http://apps.facebook.com/Nestle-Hundred-Years ["Nestlé 100 Years Facebook App"] to their members' profile.
     
     Participants may then choose to submit entries either in the form of text, photo or video.
   • Category 3 – Twitter
     
     To participate via Twitter, participants must have an account with twitter.com ["Twitter"]. Please refer to the privacy policy and the terms and conditions on the Twitter, which will bind the members and users of the Twitter.
     
     To participate, members of Twitter must login in to their Twitter accounts and submit their entry via a Tweet containing the hash tag "#Nestle100".
     
     Selected winners will be contacted via their Twitter account and will be required to complete their registration via the Microsite.
   • Category 4 – Entry Forms
     
     Participants may also participate in this Contest by submitting completed entry forms during any Nestlé road shows. Entry forms submitted via post will not be accepted for this Contest.
3. This Contest will run for a period of ten [10] months. Completed entries stand a chance to win the Best Entries and/or Monthly Prizes in each of the following months throughout the Contest Period:

4. The panel of judges will select the winners for the following categories on a monthly basis:
   • Best Entries:
     • Best Video – Top two [2] videos, comprising one in each language
     • Best Text Story – Top two [2] text stories, comprising one in each language
     • Best Photo with Caption - Top two [2] photos, comprising one in each language
     • Best Twitter - Top two [2] tweets, comprising one in each language
   • Monthly Prizes:
     • One [1] winning entry each month.
   The judging criteria of the entries will be based on creativity, originality and completeness of the entries to this Contest.
5. All entries submitted for this Contest, upon moderation by the Organiser, will be published live on the Microsite during the Contest Period. Participants who have successfully submitted their entries via the Microsite and Nestlé 100 Years Facebook App will be notified via email once their entries have been approved and published.
6. For each entry submission, participant must complete their registration by submitting their MyKad number, Mobile number, Email, and agree to the Contest Rules and Regulations herein and Nestlé Privacy and Policy.
7. Each entry received during the Contest Period will be serialized according to the time of receipt (yy/mm/dd/hh/mm/ss/). In the event of duplicate entries from the same participant, the submitted entry which is most recent will be treated as a valid entry. In the event of duplicate submissions from different participants, the first submitted entry will be treated as a valid entry based on the time of receipt.
8. Any incomplete or incorrect entries will be automatically disqualified. Each participant may submit more than one [1] entry.
9. Submission of entries must be in either Bahasa Melayu or English only.
10. No proof of purchase is required for this Contest.

Prizes

1. The Prizes for this Contest consist of the following:
   • Best Entries Category
     • Best Video – There will be a total of two [2] winners each month throughout the entire Contest Period and each will receive RM900 [Ringgit Malaysia Nine Hundred] Cash.
     • Best Text Story – There will be a total of two [2] winners each month throughout the entire Contest Period and each will receive RM700 [Ringgit Malaysia Seven Hundred] Cash.
     • Best Photo with Caption – There will be a total of two [2] winners each month throughout the entire Contest Period and each will receive RM500 [Ringgit Malaysia Five Hundred] Cash.
     • Best Twitter – There will be a total of two [2] winners each month throughout the entire Contest Period and each will receive RM200 [Ringgit Malaysia Two Hundred] Cash.
   • Monthly Prizes Category
     • Monthly Prizes – There will be one [1] winner each month throughout the entire Contest Period and each will receive RM2000 [Ringgit Malaysia Two Thousand only] Cash.
       
       The winning entries for the month of February, March, April and May will also be filmed and aired on Astro Channel.
       
       In addition, for each Monthly Prize, Nestlé will make a donation of equivalent amount to selected charity homes.

Prizes Redemption

1. All winners MUST submit a photocopy of MyKad within five [5] working days of receipt of the notification, via registered mail or courier to the address provided in the said notification, for purposes of verification in order to redeem their Prizes. Failure to furnish will result in disqualification/forfeiture of the Prize. Proof of postage shall not constitute proof of receipt by the Organiser.
2. Winners' names will be announced on Nestlé 100 Years Fanpage and will be notified via Email and/or Telephone through their contact details provided to the Organiser when they register as a Facebook member on the Nestlé 100 Years Facebook App. The Organiser will not be held liable in the event the winner(s) cannot be contacted for whatever reasons after at least three [3] attempts by the Organiser or its agents to contact the winners. All prizes must be claimed within three [3] months from the date of notification. All unclaimed prizes will be forfeited. The Organiser will not be held liable in the event of non-receipt or delayed delivery of the postal notification to the winner[s].
3. Each participant is only entitled to win a maximum of one [1] Best Entries Prize and one [1] Monthly Prize throughout the entire Contest Period. In the event that a participant wins two [2] prizes in the same and/or different category, the participant automatically wins the higher valued prize. The lower valued prize will be won by the next highest qualified entry received from the same Category.
4. The Organiser shall reserve the right at its absolute discretion to substitute any of the prizes with that of similar value, at any time without prior notice. The values of the prizes are correct at the time of printing. All prizes are given on an "as is" basis and all prizes are not exchangeable for cash, credit, other items or voucher, in part or in full.
5. All winners must abide by the terms and conditions of the parties arranging and/or providing for the prizes and the terms and conditions attached to the prizes, if any.

Liability & Responsibility

1. Winners shall assume full liability and responsibility in case of any liability, mishap, injury, damage, claim or accidents (including death) resulting from their participation in this Contest, redemption and/or utilisation of the prizes. The Organiser shall not be responsible for any liability, mishap, loss, damage, claim or accident (including death) in any manner whatsoever.
2. All recording, transportation, accommodation, personal costs and/or any other costs, fees and/or other expenses that are incurred to participate in this Contest and to redeem the prize is the sole responsibility of the winner.
3. The Organiser is not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorized access to, or alteration of, user or member communications, or any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problems or traffic congestion on the Internet and/or websites.
4. The Nestlé 100 Years Fanpage and Nestlé 100 Years Facebook App are provided on an "as is" basis and, except as otherwise prohibited by applicable law, the Organiser expressly disclaim any warranty of any kind, including, but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. The Organiser cannot guarantee and do not promise any specific results from use of the Nestlé 100 Years Fanpage and Nestlé 100 Years Facebook App. No advice or information, whether oral or written, obtained by you from us, or from or through the Nestlé 100 Years Fanpage and Nestlé 100 Years Facebook App shall create any warranty not expressly stated herein.

Rights of the Organiser

1. By submitting your entries for this Contest, all participants agree and acknowledge that all intellectual property rights thereto shall belong to the Organiser. The Organiser shall have the exclusive right to use, edit, modify and publish the entry submitted by all the participants, publish the names of the participants, in any way it deems fit for any advertising, trade, promotional purpose and for any other reason whatsoever, without any further notice to the participants and the participants shall not claim ownership or any payment or compensation on the materials. For the avoidance of doubt, the submissions will not be edited for judging purposes.
2. The Organiser reserves the right to modify, suspend or cancel this Contest in the event that it becomes not capable of running as planned, technically interfered or corrupted, including but not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the control of the Organiser, despite the best efforts of the Organiser.
3. The Organiser reserves the right, in its sole discretion, to disqualify any participant that is found or suspected of tampering with the Contest submission process, the operation of this Contest or to be in violation of the Conditions of Access of the Nestlé 100 Years Fanpage and Nestlé 100 Years Facebook App. The Organiser reserves the right to terminate the Nestlé 100 Years Fanpage and Nestlé 100 Years Facebook App member account of any person who it reasonably suspects has violated or infringed any of these general terms and conditions and the Organiser reserves the right to pursue legal action against any individual it believes has undertaken fraudulent activities or other activities harmful to this online Contest, the Contest submission process and/or the Nestlé 100 Years Fanpage and Nestlé 100 Years Facebook App.

Other Terms & Conditions

1. The Organiser, in its sole discretion, reserves the right to modify this Rules & Regulations without any prior notice, if required for the smooth running of the Contest.
2. This Rules & Regulations are prepared in English only.
3. The Judges' decisions are final and no correspondence thereon will be entertained.
4. By participating in this Contest, participants agree to be bound by this Contest Rules & Regulations, and the decisions of the Organiser.

Technical Requirements

1. All entries to be submitted must comply with the following specifications:
   • Must include at least 1 Nestlé brand
   • Must be in either English of Bahasa Melayu
   All text entries to be submitted must include no more than 100 words.
   
   All Twitter entries to be submitted must comply with the following specifications:
   • No more than 140 characters
   • Include the hash tag #Nestle100
   All photographs to be submitted must comply with the following specifications:
   • Maximum file size: 2MB
   • Format allowed: JPG, JPEG
   • Caption: no more than 20 words
   All videos to be submitted must comply with the following specifications:
   • Maximum length: 3 minutes
   • Format allowed: MPEG, AVI, WMV
   • Video title: no more than 10 words
   • Description: no more than 20 words
   Submissions that do not adhere to these requirements will be automatically disqualified. An email notification of disqualified entries will be sent out to the participants.
2. The Organiser shall not be held liable or responsible for any delay and/or failure in the receipt of entry due to the inability of the respective Internet Service Provider [ISP] company and/or telecommunication network to provide timely and/or efficient internet and/or telecommunication services.

Prohibited Content

1. Submissions must not be offensive, illegal, or infringe on the rights of others, and such submissions are subject to disqualification and deletion. Below is a partial list of content that is illegal or prohibited to be posted on the Nestlé 100 Years Fanpage and Nestlé 100 Years Facebook App. Posting of any of this content by the participant may, in the Organiser's sole discretion, result in termination of membership in addition to the disqualification of participation. In addition, the Organiser reserves the right to investigate and take appropriate legal action, in its sole discretion, against anyone who violates this provision, including without limitation, removing the offending communication from the Nestlé 100 Years Fanpage and Nestlé 100 Years Facebook App and reporting such violators to the appropriate legal authorities. Prohibited content includes, but is not limited to, contents which, in the Organiser's sole judgment:-
   • is offensive to the online community, such as content that promotes racism, politically religious agendas, inflammatory religious content, violence, foul language, bigotry, hatred or physical harm of any kind against any group or individual;
   • include ingredients that are offensive to other religious practices and/or NESTLÉ competitive products that appear in the music video;
   • harasses or advocates harassment of another person;
   • involves the transmission of "junk mail", "chain letters," "spam," or any other unsolicited mass mailing, e-mailing, or other communication;
   • includes any information that [1] the participant knows is false or misleading, [2] promotes illegal activities or conduct that is abusive, or [3] is threatening, obscene, defamatory, or libelous;
   • constitutes or includes any illegal or unauthorized copy of another person's copyrighted or copyrightable work or any other intellectual property rights, including, but not limited to, [1] pirated computer programs or links to them, [2] information which circumvents manufacturer-installed copy-protect devices, [3] pirated music or links to pirated music files;
   • displays obscene, pornographic or sexually explicit material of any kind;
   • includes material that exploits people in a sexual or violent manner;
   • provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses.
